Welcome to Tutam. These Terms of Service govern your access to and use of the website tutam.app, related landing pages, and the Tutam platform. By completing the pre-launch registration form, listing a service, or browsing the directory, you agree to comply with and be bound by these terms.

1. Company Information

The Tutam platform is operated, administered, and maintained by:

2. Purpose and Nature of the Service

  1. Tutam operates solely as an online directory and discovery platform connecting independent service providers, freelancers, local businesses, and private individuals ("Providers") with consumers seeking assistance ("Users").
  2. Tutam is not a party to any agreement, contract, booking, service provision, or financial transaction conducted directly between Users and Providers.
  3. We do not act as an employer, contractor, broker, or legal representative for any Provider listed on the platform.

3. Pre-Launch Registration, Founder Benefits, and Fees

  1. For Clients / Seekers: Searching the platform, exploring directory listings, viewing the interactive map, and contacting listed Providers is and remains 100% free of charge.
  2. Pre-Launch Registration: Submitting a profile prior to the official platform release (scheduled for January 2027) is free and non-binding.
  3. Founder Advantage (First 100 per Region): The first 100 verified Providers in each designated city or region who register prior to public launch receive 12 consecutive months of free listing starting on the official release date.
  4. Standard Subscription after the Free Year: Following the initial 12 free months, active listing on the platform is billed at a standard rate of €24 per year (equivalent to €2 per month), unless the Provider elects to pause or remove the listing prior to renewal.
  5. No Hidden Recurring Charges: No automatic payments are initiated without prior notification and explicit confirmation from the Provider.
  6. Zero Commissions: Tutam collects 0% commission on earnings, inquiries, or transactions arranged between Users and Providers.

4. Provider Responsibilities and Conduct

  1. Providers bear sole responsibility for ensuring all submitted details—including contact links, descriptions, rates, and qualifications—are accurate, truthful, and updated.
  2. Providers are entirely responsible for complying with local tax, employment, labor, and commercial laws in the jurisdiction where their services are rendered.
  3. Publishing misleading, fraudulent, discriminatory, defamatory, or unlawful content is strictly prohibited.
  4. Assiste reserves the right to decline, suspend, or permanently remove any listing that breaches applicable laws or undermines the safety and standards of the Tutam community.

5. Limitation of Liability (Disclaimer)

  1. Service Quality & Performance: Assiste and Tutam assume no responsibility or liability for the safety, legality, punctuality, standard, or execution of services performed by independent Providers.
  2. Dispute Resolution: Any claims, cancellations, disagreements, or damages arising from a booked service must be resolved directly and exclusively between the User and the Provider.
  3. No Guarantee of Commercial Outcome: Tutam delivers digital visibility and connection tools, but does not guarantee a minimum number of inquiries, leads, bookings, or revenue.
  4. Platform Availability: While we strive to maintain uninterrupted service, we do not warrant continuous, error-free site operation during technical maintenance, outages, or circumstances beyond our reasonable control.

6. Intellectual Property

All proprietary materials—including platform branding, text, visual design, graphic assets, trademarks, and source code—are the intellectual property of Assiste. Unauthorized reproduction, modification, scraping, or distribution of these assets is prohibited without prior written consent.

7. Account Termination and Listing Removal

  1. Providers may request the removal of their profile and listing from Tutam at any time by sending an email to info@tutam.app.
  2. Upon confirmation of the request, public display is promptly disabled, and stored data is processed in accordance with our Privacy Policy.

8. Governing Law and Jurisdiction

  1. These Terms of Service and any non-contractual obligations or disputes arising out of or in connection with them are governed exclusively by the laws of the Netherlands.
  2. Any legal disputes that cannot be settled amicably shall be submitted to the jurisdiction of the competent court in the Netherlands, without prejudice to mandatory statutory protections afforded to EU consumers under applicable local laws.
